Srinagar, August 15, KDC: A local court in Anantnag has temporarily restrained the Khovripora Cooperative Marketing Society Ltd from causing any obstruction to an existing pathway connecting residential properties and agricultural lands in Hutmurrah village.
The order was passed by the Court of Civil Judge Senior Division (Sub Judge) Anantnag, Sajad-Ur-Rehman, while hearing an application for interim relief moved by the inhabitants of Village Hutmurrah through Advocate Zul-Eyenain.
The inhabitants submitted before the court that their residential houses and nearly 400 kanals of agricultural land are situated alongside KP Road, with their sole access route passing adjacent to the Khovripora Cooperative Marketing Society building.
According to the inhabitants, the land occupied by the society falling under Survey Nos. 506-Min, 826/506, and 511-Min was originally contributed by village residents on the understanding that common passage would remain unobstructed.
The inhabitants alleged that the Cooperative Society recently caused encroachments and blocked the 10 to 12 foot wide pathway, severely affecting regular vehicular movement, emergency services, and agricultural activities. They further expressed apprehension regarding potential third-party interest creation on the site.
Observing that a prima facie case was established and that the balance of convenience tilted in favor of the applicants to prevent irreparable loss, the court issued notice to the defendants.
In the interim, the court restrained the defendants from obstructing the 10-foot pathway situated at Hutmurrah.
The interim order remains subject to objections from the opposing side, with the matter listed for the next hearing on September 27, 2026. (KDC)
