Srinagar, Sept. 29, KDC: Reaffirming that premature retirement is an administrative mechanism designed to maintain integrity in governance rather than a penal sanction, the High Court of Jammu & Kashmir and Ladakh has held that compulsory retirement under the Jammu and Kashmir Civil Services Regulations (JKCSR) is neither punitive nor stigmatic, ruling that the pendency of unproved vigilance allegations does not bar the government from retiring an employee in the public interest.

Allowing a Letters Patent Appeal a Division Bench comprising Chief Justice Dr. Pushpendra Singh Bhati and Justice Sanjeev Kumar set aside a 2018 Single Judge judgment and restored Government Order No. 1264-GAD of 2016 dated November 21, 2016, which had compulsorily retired Ghulam Mohammad Lone, a resident of Lawaypora, Srinagar, after 38 years of service.

Lone, who had attained 58 years of age and was serving in the School Education Department, was retired under Article 226(2) of the JKCSR following recommendations by a state screening committee. The committee had taken into account his overall service profile, average performance reports, and his alleged involvement in Vigilance Organization FIR No. 18/2010, registered after he was caught allegedly demanding and accepting a bribe of Rs 9,000.

A Single Judge had quashed the retirement order in October 2018, holding that the material was insufficient to conclude that Lone had outlived his utility or that his continuance was prejudicial to public interest.

Assailing the Single Judge’s verdict, Deputy Advocate General Hakim Aman Ali contended that judicial review over compulsory retirement is limited, arguing that the court had erroneously substituted its own assessment for the subjective satisfaction of the competent authority and treated the administrative measure as if it were a disciplinary punishment.

In defense, Advocate Imtiyaz A. Sofi, appearing for the employee, submitted that Lone had an unblemished service record with regular promotions, arguing that mere registration of an FIR without a concluded finding of guilt could not serve as a valid basis to end his service prematurely.

Re-evaluating the jurisprudence governing premature retirement, Chief Justice Dr. Pushpendra Singh Bhati observed that courts exercising judicial review do not sit as appellate bodies over administrative assessments:

“The ratio emerging from these judgments is that premature/compulsory retirement is an administrative measure taken in public interest and is neither punitive in nature nor stigmatic. It does not amount to dismissal or removal by way of punishment and does not, merely by reason of its character, entail civil consequences by way of stigma. The power is intended to enable the Government to maintain efficiency, integrity and effectiveness in public administration and to weed out employees whose continued retention is considered detrimental to public interest,” the Court said.

Addressing the reliance placed on the pending bribery case, the Division Bench held that a concluded conviction is not a prerequisite for administrative retirement:

“Accordingly, the mere fact that the respondent had challenged the allegations contained in the FIR, or that the criminal proceedings had not culminated in conviction, cannot by itself determine the legality of an order of premature retirement. The relevant enquiry is whether the material before the Screening Committee and the competent authority was legally relevant and whether, on consideration of the service record as a whole, a bona fide opinion could reasonably be formed that the employee’s continuance was not in public interest. This is materially different from determining the respondent’s criminal guilt,” the DB held.

The Bench underlined that judicial interference is restricted to cases tainted by demonstrable mala fides, complete absence of material, arbitrariness, or consideration of extraneous factors, observing, “It is, therefore, held that premature/compulsory retirement is neither punitive in nature nor does it entail any civil consequences by way of stigma. The order is an administrative measure founded upon the subjective satisfaction of the competent authority regarding the public interest involved in retaining or retiring a Government servant. The Court, while exercising judicial review, cannot substitute its own opinion for that of the competent authority merely because another view may also be possible.”

Examining Lone’s Annual Performance Reports (APRs) from 2011 to 2015, the High Court noted that his performance had been assessed as satisfactory or average and was not of such an exceptional character as to warrant retention in service as a matter of right.

Holding that the screening committee’s recommendation was founded on relevant material, the Division Bench allowed the State’s appeal, reversed the Single Judge’s decision, and upheld the 2016 premature retirement order. (KDC)
