Srinagar, August 30, KDC: The High Court of Jammu & Kashmir and Ladakh has directed the Union Territory administration not to deal with proprietary land in Bandipora district for setting up a police post without adopting due course of law.
Issuing notice to the J&K administration, a Bench of Justice Rahul Bharti passed the interim direction on a writ petition filed by Bashir Ahmad Dar and others, who challenged the proposed acquisition and reservation of their private land for police infrastructure.
The petitioners submitted before the court that they hold proprietary rights over land comprising Khasra No. 662 min situated in village Poshwari Naidkhai, Tehsil Hajin, District Bandipora, having inherited the legal title from their deceased father.
They approached the High Court raising a grievance that the authorities, without following the statutory acquisition framework or adopting due course of law, were moving to reserve their proprietary land for establishing a police post.
Issuing formal notices in the main petition as well as the connected interim application, Justice Bharti directed that the land shall not be interfered with unlawfully.
“In the meantime, the land in khasra no. 662 min to the extent it relates to the petitioners’ father, shall not be dealt with, without adopting due course of law,” the Bench ordered.
The matter has been directed to be listed for further consideration on September 30, 2026. Advocate G. M. Bhat appeared on behalf of the petitioners. (KDC)
