Srinagar, Aug 17, KDC: The Jammu and Kashmir Anti-Corruption Bureau (ACB) has produced a chargesheet against 10 accused persons, including seven officers/officials of the Srinagar Municipal Corporation (SMC) and three private individuals, in a case related to alleged illegal and unauthorized construction in Ward No. 28, Batamalloo, near Tiny Hearts School, Tengpora, Srinagar.

The chargesheet in FIR No. 06/2023 registered at Police Station ACB Srinagar was produced before the Court of Special Judge, Anti-Corruption, Srinagar, for judicial determination.

The accused have been booked for offences under Section 5(1)(d) read with Section 5(2) of the J&K Prevention of Corruption Act, Svt. 2006, Section 120-B RPC, Section 4-A of the R&D Act and Section 9-A read with Section 20 of the Evacuees (Administration of Property) Act, 1949 AD.

According to the ACB, the case was registered following allegations that officers/officials posted in Ward No. 28, Batamalloo, of the Srinagar Municipal Corporation abused their official positions and entered into a criminal conspiracy with private beneficiaries to facilitate and allow illegal and unauthorized construction in the area near Tiny Hearts School, Tengpora.

The principal beneficiary has been identified as Reyaz Ahmad Dar, son of Abdul Rahim Dar, resident of Tengpora, Batamalloo, Srinagar.

The SMC officials named in the chargesheet include Ghulam Rasool Dar, retired Chief Enforcement Officer; Bashir Ahmad Shah (Shaheen), retired Enforcement Officer; Fayaz Ahmad Dar, retired Ward Officer, Nighat Ara, the then Building Inspector, Ward No. 28, Batamalloo, presently I/C Ward Officer, Ward No. 20, Jamalatta; and other concerned officials.

The case also involves two officials from the Custodian Department, whose names are included among the accused in the chargesheet.

The ACB said the investigation was conducted on the basis of oral and documentary evidence, which, according to the agency, substantiated the allegations against the accused government functionaries and private beneficiaries.

The investigation allegedly established a criminal conspiracy between the government officials and the private beneficiary, resulting in the alleged conferring of undue benefit by facilitating unauthorized construction.

After obtaining the requisite sanction for prosecution of the public servants from the Government, the ACB produced the chargesheet against all 10 accused persons, including the three private beneficiaries, before the Court of Special Judge, Anti-Corruption, Srinagar, for judicial determination.
