Budgam, Dec 23 (KDC): A Special NIA Court in Budgam has ordered the attachment of immovable property belonging to absconding accused Dr Ghulam Nabi Shah alias Dr Fai in connection with a case registered under the Unlawful Activities (Prevention) Act (UAPA) at Police Station Budgam.
The order, a copy of which lies with news agency Kashmir Dot Com (KDC), was passed by the Court of the Special Judge (NIA), Budgam, after the accused failed to appear before the investigating agency despite the issuance of a proclamation. The court noted that Dr Fai was earlier declared a proclaimed absconder on April 26, 2025, in FIR No. 46/2020 registered under Sections 10, 13 and 39 of the UAPA.
The prosecution, through the Investigating Officer, moved an application seeking attachment of the accused’s property under Section 83 of the Criminal Procedure Code (now Section 85 of the Bharatiya Nagarik Suraksha Sanhita). It was submitted that the accused had deliberately evaded the legal process and concealed himself to avoid arrest, compelling the authorities to seek attachment of his assets.
As per the revenue records placed before the court, the accused owns land measuring 01 Kanal and 02 Marlas under Khewat No. 60, Survey No. 466 Min at Village Wadwan, Budgam, and 11 Marlas of land under Khewat No. 136, Survey No. 343 Min at Village Chattabugh, Budgam.
The court was informed that the said properties are presently in possession of the accused’s brothers in both villages. The prosecution further submitted that there was a strong likelihood of alienation of the land, which could frustrate the legal proceedings initiated against the accused under the law.
After perusing the records and hearing the prosecution, the court observed that despite being given sufficient opportunity to appear before the Investigating Officer, the accused intentionally chose not to comply and remained absconding. The court held that the conduct of the accused justified attachment of his property under the relevant provisions of law.
Accordingly, the court directed the District Collector, Budgam, to attach the immovable properties and take possession forthwith. The Collector has been instructed to ensure the assistance of revenue authorities for proper identification and demarcation of the land before attachment.
The court further ordered that the SSP Budgam shall provide necessary police support, if required, during the process of attachment. Copies of the order have been directed to be furnished to the District Collector and SSP Budgam for compliance.
The order was pronounced on December 23, 2025, by the Special Judge, NIA Court, Budgam, and the application was disposed of accordingly. (KDC)
