Srinagar, August 12, KDC: The High Court of Jammu & Kashmir and Ladakh has dismissed a petition solely due to a typographical error in the name of the Union Territory, while simultaneously ordering an internal inquiry against registry officials for approving the defective filing.
A Bench of Justice Rahul Bharti passed the order while hearing a petition filed by Sajad Hussain Khan and another through advocate Sabiya Hilal.
Upon scrutinizing the cause title of the petition, the Court, according to news agency Kashmir Dot Com, observed that respondent No. 1 was misnamed as “UNION TERRITORY OF JAMMJU AND KASHMIR” instead of the statutory designation “UNION TERRITORY OF JAMMU AND KASHMIR”. Refusing to entertain the defective filing, Justice Rahul Bharti dismissed the petition on grounds of misnomer.
“This petition is dismissed for misnomer of respondent No.1 as instead of writing ‘UNION TERRITORY OF JAMMU AND KASHMIR’ the reference is ‘UNION TERRITORY OF JAMMJU AND KASHMIR,'” the Court said.
Taking serious exception to how such a “glaring typo” cleared the initial registry screening, the Bench directed the Registrar Judicial, Srinagar, to initiate an immediate inquiry into the lapse at the Examination Counter.
“This Court directs Registrar Judicial, Srinagar to enquire into the slip of attention on the part of Examination Counter as to how such a glaring mistake to the extent of misnaming ‘UNION TERRITORY OF JAMMU AND KASHMIR’ has taken place by allowing the petition to be filed and defectively and approved for listing. The erring official be put to accountability with all seriousness to set a standard for the rest to stay vigilant in the discharge of their duty with final report to be submitted to the learned Registrar General,” the Bench ordered.
