Srinagar, August 13, KDC: Deputy Commissioner Ganderbal, Shyambir Singh, on Tuesday tendered an unconditional apology to the Chief Judicial Magistrate (CJM) Ganderbal. This comes after the High Court on Monday granted the DC two days to consider filing an apology.
“In the above captioned matter, Mr. Shyambir Singh Deputy Commissioner Ganderbal, who is facing criminal contempt before Hon’ble High Court of J&K having been referred by this Court, appeared and filed an application seeking apology,” reads an order issued by CJM Ganderbal, Fayaz Ahmad Quresh, a copy of which is with Srinagar-based news agency Kashmir Dot Com.
“A written apology in the form of an affidavit has been filed stating therein that there has never been any deliberate or wilful attempt to interfere with the administration of justice and that in view of the contempt proceedings drawn by the Hon’ble Court of Ld. Sub-Judge/Chief Judicial Magistrate Ganderbal against the deponent, the deponent therein tenders his sincere apology in the instant matter. The apology in the shape of an affidavit has been attested by Executive Magistrate 1st Class Ganderbal,” the order reads.
The order further states, “This court provided sufficient time to the respondent-Mr. Shyambir Singh Deputy Commissioner Ganderbal to ponder over his apology. The respondent verbally reaffirmed that he is tendering the apology sincerely and he undertakes that he will not cause any interference in the judicial functions and will always respect the courts of law. The apology has been placed on file and a copy of the same is submitted to Hon’ble High Court of J&K and Ladakh for further kind orders in light of the apology tendered before this court.”
The contempt case against Deputy Commissioner Ganderbal, Shyambir Singh, arises from a land dispute where a lower court ordered the attachment of salaries of several government officials, including the DC.
The DC is accused of pressuring the judge and interfering with the judicial process by deploying a revenue team to survey the judge’s land without proper notice.
The Chief Judicial Magistrate initiated contempt proceedings, which were subsequently referred to the High Court.
On Monday, the 2018 batch IAS officer apologized for his behavior before a Division Bench of the Jammu & Kashmir and Ladakh High Court.
However, the Court sought further demonstration of remorse from the DC by asking him to voluntarily approach the Chief Judicial Magistrate (CJM) of Ganderbal.
